Faculty Workload Settlement Agreement
Dear Baruch Faculty Colleagues:
You are probably aware that our contract with the PSC specifies 21 workload units per year for professorial faculty, and 27 for lecturers, and the contract further requires that deviations from this workload must be resolved within a three-year window. Baruch College staff recently discovered that we have not been resolving full-time faculty workload deviations, overloads and underloads, in a way that is consistent with the timeline established in the December 19, 2001, settlement agreement between the PSC and CUNY. During the past several months we have worked with the PSC to develop a plan that ensures compliance with the contract, and that characterizes any unintended consequences of the incorrect process that we had been using.
Under the terms of the PSC-CUNY contract, as clarified in that settlement agreement, faculty have three academic years to resolve any workload imbalance, and the three-year count begins with the academic year during which the overload or underload occurs. Baruch College’s incorrect practice had been to allow faculty an extra year to resolve those imbalances and to address them on a rolling basis.
For example, a three-credit teaching ‘overload’ that occurred in fall of 2011 or spring of 2012 and was followed by an additional three-credit overload in the 2012-13 academic year would contractually require a six-hour workload reduction by the close of 2013-14 academic year. We incorrectly permitted the faculty member until the close of the 2014-15 academic year to resolve the first three-credit overload and until 2015-16 to resolve the second three-credit overload imbalance. Thus, we were authorizing an additional year, and treating the two overloads as separate events on a rolling calendar.
Committed to transparency, fairness, and adherence to the contract, the College has agreed with the PSC to correct our practice. This means that any workload imbalance dating from the 2013-14 academic year will need to be resolved by the close of the AY15-16. If a second imbalance occurs in AY14-15, it must also be resolved by the close of AY15-16. In other words, the first instance of a workload deviation triggers a window during which workload balance must be achieved; every full-time professorial faculty member must report 63 workload units during the three-year window; every full-time lecturer, 81 during the three-year window. The only exception made will be for workload imbalances dating from AY12-13. We want to provide affected faculty sufficient time to address those imbalances. Consequently, faculty will be given until the close of AY15-16 to resolve imbalances dating from AY12-13.
This change will not result in any significant difference in workload or workload history for the overwhelming majority of our faculty. We have not identified any cases where this correction has extraordinary impacts on any individual, and we shared our analysis with the PSC. Of course, you will each be able to assess this for yourselves shortly. The Office of the Provost will forward workload reports to deans by December 12, 2014. The workload reports will represent imbalances that must be addressed within a specified timeline. Next semester and each subsequent semester, each of you will receive both a workload report and a multi-year summary that will detail several years of workload history and the timeline for addressing any imbalance. You will receive both documents whether you have an imbalance or not.
